Statement: EHRC Code of Practice questions show this is not a settled issue

Today the Government heard from MPs who challenged the EHRC’s updated Code of Practice, who described it near-unanimously as broken, undignified and unworkable.

We thank the MPs who raised pointed questions, and who shared the stories and concerns of trans constituents facing discrimination and segregation following the publication of the EHRC’s proposed guidance.

But rather than provide clarity or comfort, the Government ignored the concerns of our community, refused to explain how relegating us to third spaces is fair or dignified, and failed to address worries over the significant costs that organisations will face to meet the Code’s contradictory requirements.

The Government knows that this Code will have a profoundly negative impact on the lives of trans people in the UK, yet remains committed to pushing it through without a vote regardless.

This is not a settled issue. The Government still has time to do the right thing, to withdraw the Code and restore the rights and protections that trans people had held for over a decade.
