The EHRC Code of Practice has come into force in Parliament – but what does that mean?
The Government’s updated Code will now come into effect on 5th August 2026, following an order from the Minister for Women and Equalities. Existing guidance will be revoked and replaced by the new Code of Practice as statutory guidance.
This means that the Code is not law itself, but rather a framework for operating within the law following the Supreme Court’s judgement last year.
We maintain, however, that the new Code remains unworkable; it does not protect trans people, it does not help service providers and it does not respect the UK’s human rights obligations. Despite widespread cross-party backlash over these clear failings, the Government has pushed ahead without a debate or a vote.
